Ex-Goldman director gets two years in prison for boardroom leaks

NEW YORK (Reuters) - Fallen Wall Street insider Rajat Gupta was sentenced to two years in prison on Wednesday for leaking Goldman Sachs boardroom secrets to the hedge fund manager at the center of the U.S. government's crackdown on insider trading, a much lighter sentence than prosecutors had sought.

Gupta, 63, who also is a former global head of the McKinsey & Co management consultancy, is the most influential corporate figure to be convicted in a wide U.S. probe of insider trading involving hedge fund managers, traders, consultants and executives.

A Manhattan federal jury in June found him guilty of feeding tips about Goldman Sachs at the height of the 2008 financial crisis to hedge fund tycoon Raj Rajaratnam, his friend and business associate.

The sentence was far less than the eight to ten years that prosecutors had sought, but more than the punishment of probation and community service that Gupta's lawyers had requested.

The sentence was imposed by U.S. District Judge Jed Rakoff, who questioned why Gupta had turned his back on an "extraordinary" and "selfless" life to commit a crime he did not profit from directly.

Gupta's crime was "the functional equivalent of stabbing Goldman in the back," Rakoff said. "So why did Gupta do it?"

Indian-born Gupta also once sat on the boards of Procter & Gamble Co and American Airlines. He also had advised philanthropies such as the Bill and Melinda Gates Foundation.

Rajaratnam is serving 11 years in prison, one of the longest sentences for insider trading, after his May 2011 conviction.

Tesla CEO Elon Musk Fires Back At Angry Auto Dealers

Under heavy criticism from car dealers, Tesla CEO Elon Musk fired back this week in a blog post published on the company's website.

Dealers filed suit against the electric carmaker last week for opening company-owned dealerships. Tesla?s stores, the dealers allege, violate state laws designed to prevent automakers from opening company dealerships that compete with independently-owned franchises.

In a blog post published Monday, Musk said his stores weren?t breaking any rules and the firm wasn?t seeking to change any state laws. The Silicon Valley entrepreneur also shed light on why he chose to pursue company-owned stores, rather than the traditional franchise dealership model.

?Existing franchise dealers,? he wrote, ?have a fundamental conflict of interest between selling gasoline cars, which constitute the vast majority of their business, and selling the new technology of electric cars.?

?It is impossible for [existing franchise dealers] to explain the advantages of going electric without simultaneously undermining their traditional business,? Musk added. ?This would leave the electric car without a fair opportunity to make its case to an unfamiliar public.?

Tesla now operates 17 stores in 10 states, with another six scheduled to open this fall, according to Automotive News. Most of the stores are located in shopping malls and the company has said it doesn?t allow consumers to buy vehicles on-site; it merely educates passersby on electric cars and gives them Tesla?s website, where they can reserve one.

Bob O?Koniewski, executive vice president of the Massachusetts State Automobile Dealers Association, told Automotive News that Tesla?s current model, if successful, could encourage other electric car makers to create a separate system that bypasses dealers. ?It?s extremely problematic,? he said in an interview with the newspaper.

The National Automobile Dealers Associated said in a press conference Tuesday that it will not challenge Tesla's stores. "We support the theme of the franchise and would prefer that the manufacturer not sell direct, but it will be up to the states to pursue whatever franchise laws they have,? David Westcott, chairman of NADA, was quoted as saying in a Bloomberg report.

As the Wall Street Journal notes, Tesla isn?t the first auto manufacturer to bump up against franchise car dealers, who have ?built a legal and political fortress around their businesses strong enough to survive almost any attack this side of Armageddon.?

Scott Painter had to make major changes to his car-shopping site, Truecar.com, after it started eroding profits at independent dealerships around the country and, in late 2011, drew the ire of powerful auto dealer trade groups, according to the WSJ.

Realizing what he?s up against, Musk?s defense of his company?s stores Monday ended on a somewhat lofty note.

?At Tesla, we will continue to focus on the future and the future of your children, grandchildren and their children,? he wrote. ?In order to accelerate the adoption of EVs, we must be able to create and execute a business model that allows us to advance the knowledge of EVs in a convenient, accessible, no pressure environment.?

A building in pink steel because beating breast cancer takes mettle

Oct. 23, 2012

Dive summary:

  • Fabricating and erecting steel in October ? Breast Cancer Awareness Month ? for a medical client that will have doctors detecting and treating the disease makes pink steel obvious, but only after Harold O'Shea Builders in Springfield, Ill., thought of it and Selvaggio Steel made it.
  • The steel ? which you can stop by and sign if you happen to be in Springfield on Thursday ? will be visible until January, the contractors say. It speaks to the Springfield Clinic's health message for its $61 million facility.
  • Selvaggio says it is trying to keep careful pace with the steel production because it does not foresee a lot of other demand if it mixes too much pink paint.

With the creative use of some colorful materials on a $61 million medical-center building under way in Springfield, Ill., the project's locally based team is driving home a client?s message. ...

Beat Procrastination and Distractions By Scheduling Time for Them

Beat Procrastination and Distractions By Scheduling Time for ThemBeat Procrastination and Distractions By Scheduling Time for Them That urge to check Facebook or visit another time-wasting site isn't going to go away. So instead of struggling with it, make it part of your workday, says habit-changing author Charles Duhigg.

In the video above, he explains why:

In all the studies of procrastination, what they've basically said are two things: number one, you can't find some work reward that's going to take the place of procrastination. Right? If the reward for procrastination is that you get to spend five minutes distracted by Facebook, you have to allow yourself to do that. That has to be part of your work day. If you need five minutes every hour to look at tweets or to just surf the internet, you need to schedule that into your schedule, allow yourself to do that. Because when people start procrastinating, what they've done is, they've tried to ignore that urge. They try to deny themselves time on Facebook or time surfing the web. And then all of a sudden, it erupts and they go and they say, I'm just going to check for five minutes, and 45 minutes later, they've lost, you know, all of this time. It's because they haven't accommodated that need.

So give yourself five minutes every hour to look at cute baby animals if you like (hey, LOLcats might even make you more productive).

Calipari uses ?communications guru? to help team | John Clay's ...

Before the football season, UK Coach Joker Phillips brought in communications guru Steve Shenbaum to help with some team-building exercises. The cynical would argue that that move didn?t work too well, but considering the football team?s youth, injuries and difficult schedule, it?s hard to blame a communications guru.

And UK basketball coach John Calipari posted yesterday on Twitter that he, too, is using Shenbaum, and that the guru helped with the team?s practice on Sunday.

?

You might remember Shenbaum as a former actor who appeared in the TV seriesDharma and Greg and?Beverly Hills 90210?and the movies?American Pie?and?Big Fat Liar.

He developed communication strategies that he now uses with college athletic teams. He also helped the UK soccer teams when he was in Lexington earlier in the fall.

(AP) ? Name just about any trophy, lifetime achievement award or honorific, and Garth Brooks can claim ownership.

Sunday night he'll get the big one: Country Music Hall of Fame member.

Brooks will be inducted along with Connie Smith and Hargus "Pig" Robbins in a surprise-packed performance at the Country Music Hall of Fame & Museum in Nashville.

Trisha Yearwood says she's rarely ever seen her husband so worked up.

"I don't know if there's anybody who's received more honors, and I've never seen anyone so excited," she said in a recent interview with Brooks. "I've never seen him as excited about such an honor."

It's a well-deserved honor for the man who took country music from a regional sound to an international phenomenon. It's also one the 50-year-old balked at, though he's become more comfortable with it.

"When they announced it, all I could think about was the guys who aren't in there that should be before me," Brooks said. "And as we've gotten closer I see that, but I just can't help be like a little kid at Christmas. It's going to be a great, great, great night."

Writer Unboxed ? Building Your Writer Platform ? How Much is ...

GIVEAWAY: I am excited to give away a free copy of either the new & updated 2013 Guide to Literary Agents or the 2013 Children?s Writer?s & Illustrator?s Market to a random commenter. Comment within one week; winners must live in Canada/US to receive the book by mail. Good luck to all!

I often discuss how to build a writer platform on my Guide to Literary Agents Blog and when I speak at writers? conferences. In the blog posts and during the speeches, I found myself often using phrases similar to the following:

  • ?To achieve impressive blog stats??
  • ?Then, when your newsletter gets big enough??
  • ?That way, you can get invited to speak more and that will help you get an agent??

But after I used such generic phrases a few times, the big question started to come from readers and conference attendees: How much is enough?

How do agents and editors define ?impressive blog stats?? When can you say you have a ?sizeable newsletter?? How many speaking engagements should you have each year before you feel confident in sending a nonfiction book proposal out on submission? Should you wait till you have a certain number of Twitter followers or Facebook fans before querying?

Wow. Great questions ? and ones that aren?t really addressed anywhere on the Internet because it?s such a subjective answer. But I?ll try to tackle them here real quick.

THE ANSWER VARIES FOR EVERYONE

The first thing you need to realize is that this question of ?enough? will be different for everyone depending on the writer?s niche. If you?re writing about something specific?say, eclipse chasing?then your audience is quite a thin slice of a pie, and a smaller platform may be quite impressive in your very specific arena. Heck, you could have 2,500 Twitter followers and that may be enough to get you a small book deal with a university press. If you?re writing about something broad and popular, such as finance, your platform will have to be a lot larger if you hope to impress an agent.

The size of your desired book deal also factors in. If you dream of getting paid $50,000 or $100,000 upfront for your book, then your platform must warrant such a large advance. If your goal is simply to get a book published?even if that means with a smaller press that pays little?then platform demands can drop, perhaps drastically.

Naturally, when talking about anything subjective, we must acknowledge that there will be exceptions to the rule. I have no doubt somebody can stand up and say, ?I didn?t even know what a platform was, but my book got published!? just as there will be someone who says, ?My social media numbers are excellent, and I still can?t find a publisher!? What we discuss here are just guidelines; there are exceptions to every rule.

NUMBERS TO AIM FOR?SOME BROAD STROKES

All that being said, let me share some very broad thoughts on what you should be aiming for. These numbers below are directed toward writers of nonfiction, where platform is crucial and mandatory. If you?re writing fiction (where platform is not necessary but still helpful), you can strive for statistics lower than the ?Notable? thresholds below and still appear attractive to publishers.

Blog Page Views

Very Notable: 100,000/month

Very Notable: Speaking to 3,000 people (total) a year
Impressive By Any Means: Speaking to 15,000 people (total) a year

Sales of Previous Self-Published Books
Notable: 2,000+ for fiction; 4,000+ for nonfiction
Very Notable: 6,000+ for fiction, 10,000+ for nonfiction
Impressive By Any Means: 15,000+ for fiction, 30,000+ for nonfiction

AGENTS CHIME IN: ?When is a writer?s platform ready??

?I think a lot of that is going to both depend on and determine what level of publisher your book is likely to appeal to. There?s no ?critical mass? of platform, and, in many cases, there?s going to be a natural plateauing of what you can achieve at this stage since platform feeds the book feeds the platform. Very large commercial publishers are hoping for, and can attract, writers with large national platforms like nationally syndicated columnists. You may be unable to achieve such an accomplishment before you want to submit your book, or your ideal publisher may not require such lofty extremes for your platform. What can you achieve? You may not have a regular column in a big magazine, but if you sell regularly to a number of large pubs, mention the readership of each in your proposal. Maybe you?re blogging for The Huffington Post ? Keep in mind that you don?t sacrifice a timely story to continue to build platform and perhaps miss the most opportune window to submit the book. And don?t assume a long history is better than recent history. Publishers want to see recent platform, recent exposure.?
- Gina Panettieri (Talcott Notch Literary Services)

?It?s helpful to remember that not everyone who is part of your audience will actually buy the book?let?s say 10 percent, for example (not a real number, by the way). So if you have 100,000 followers (10,000 copies sold), it?s a lot more appealing than 500 followers (50 copies sold). And if you have social media, speaking engagements, and TV appearances, they can only help. For social media, I will start to be impressed when a writer has about 5,000 followers/fans/people, but 10,000 is really ideal. Speaking engagements should happen frequently and for a substantial audience. What I look for is national and international appeal, but that can start with regional and local opportunities.?
- Roseanne Wells (Jennifer De Chiara Literary Agency)

?This is a really good question. I?ve had projects I?ve been interested in or maybe even have signed up with the understanding that there?s work to be done in the way of building or improving the platform before a publisher will be interested. When you can take a project out and have an expectation that it won?t get shot down on the basis of platform is a judgment call (as is which publishers will feel there?s enough platform there, and whether more is necessary to target the ideal publisher). But there?s no real answer for ?How much is enough?? The platform is something that should be constantly (if incrementally) growing and evolving over the author?s career. Even if one of my authors already has a great platform, I will forward him or her any contact or idea I think may be useful to make it even stronger. I can recall at least one author who accused me of constantly ?moving the goalposts.? She said that she?d done what I?d asked and now I was asking for more. But that?s missing the point. There isn?t a line in the sand that you need to get across. It?s demonstrating your involvement in?or even your necessity to?the world you are writing about. And that isn?t any one thing.?
- Stephany Evans (FinePrint Literary Management)

From the Editor's Desk: The acts of children ...

Phil Nickinson

We're in the tall grass now, boys and girls. We're at that point in the year when Google's got a new Nexus coming down the pike, and the smartphone nerds are getting that annual tingling sensation not felt since puberty, or the release of the previous Nexus. All sanity and logic goes out the window, and drama ensues.

That, of course, brings us to the object of last week's infection, that painfully obvious fake "Sony Nexus X." Make no mistake, folks -- it was pretty clear from the start that it wasn't real. I said as much on Twitter before we published. Others were a bit stronger. Internally, we knew what we were looking at. I was done. But Alex likes to walk through this stuff, and he's got a good eye for debunking, so I gave him the green light. Could our post have been stronger? Perhaps. But I love that British sense of understatement. When our headline called the pictures "dubious," that's code for "utter shite." Make no mistake -- somebody was being polite.

I've never understood why folks throw out reason when it comes to new phones. Some call it "hypebeasting." I call it a pain in our collective asses. Fakes are nothing new, and they all have one thing in common: Frauds like these are perpetrated by feckless children, starved for attention. That's it. And in this case, it's twice as bad as you think. There's the attention the initial fraud receives, and then the added attention of when someone "comes clean," which is to say they own up to having lied, and we should all love them now for no longer lying. Someone should be rewarded for that? That's not what I teach my 6-year-old daughter, who's able to understand why that's wrong. I hate that I'm still talking about this, that I've given it the weight of this column.

But, frankly, I'm glad the kid who wasted his time with all this didn't even realize that we'd called bullshit, and that explained why. And I'm especially glad he didn't list us as his favorite Android site. An endorsement from a pathological liar is not an endorsement I want. I'm funny like that, I guess.

Good news, everyone! I've got happier thoughts ahead.

Bell dealt to D-backs, who trade Young to Oakland

PHOENIX (AP) ? Heath Bell became the latest player jettisoned by the Miami Marlins when he was dealt Saturday to the Arizona Diamondbacks, who also acquired infielder Cliff Pennington from the Oakland for outfielder Chris Young.

Arizona obtained Pennington and minor league infielder Yordy Cabrera from Oakland for Young and cash, then sent Cabrera to the Miami Marlins for Bell. The Marlins will pay $8 million of the remaining $21 million Bell is owed.

Earlier in the day, Arizona exercised a $6.5 million option on closer J.J. Putz.

The 35-year-old Bell has 151 saves the past four seasons. He signed a $27 million, three-year contract with Miami last offseason but lost his closer's job in July. He finished with 19 saves in 27 chances and a 5.09 ERA in in 73 games.

After failing to contend in the first season of their new ballpark, the Marlins traded former NL batting champion Hanley Ramirez to the Los Angeles Dodgers in July and sent pitcher Anibal Sanchez and infielder Omar Infante to the Detroit Tigers.

Arizona general manager Kevin Towers said Bell provides a right-handed power arm to help set up Putz and Pennington adds the team experience at shortstop and second base.

Towers, who was general manager in San Diego when Bell was the setup man for Trevor Hoffman, believes the pitcher will benefit from a return to the NL West.

"I think he's excited to kind of be able to clean the slate," Towers said.

Bell contract calls for $9 million in each of the next two seasons and includes a $9 million club option for 2015. Miami will pay $1.5 million next year, $3.5 million in 2014 and the $3 million deferred signing bonus he is owed.

Young, Arizona's center fielder for six seasons, was the odd man out in a crowded outfield with the team expecting young Adam Eaton, called up from Triple-A Reno late this season, to play center and be the Diamondbacks' leadoff hitter. But Towers said the job is automatically Eaton's. Gerardo Parra and A.J. Pollock also will compete for the spot.

Young will be reunited with Bob Melvin, who was his manager in Arizona.

"It caught me off guard a little bit, I'm not going to lie," Young said. "It's all settled in a couple hours now. I got an opportunity to talked to Billy (Beane) and got to talk to BoMel. I'm excited to help. It's a new opportunity, a fresh start for me personally."

Pennington, 28, played in 125 games for the A's. He had 93 appearances at shortstop but was shifted to second base in last August. A switch hitter, Pennington hit .215 last season, including .168 against left-handers, and had 28 RBIs.

"He had a down year. That happens. Guys have down years," Towers said. "Heath had a down year. That's why we were able to make these deals."

He said he believes Pennington can be an everyday shortstop plus fill in behind Aaron Hill at second. The team also has Willie Bloomquist and John McDonald at short.

Towers said that Bell may have been uncomfortable with his high-profile signing in the Miami makeover.

"Maybe a lot of it had to do with the pressure, his first big contract," Towers said, adding that Bell "was really the first big signing" the Marlins had in the offseason.

The Arizona general manager believes his bullpen ? led by Putz, David Hernandez, Brad Ziegler and now Bell ? "is as good a bullpen as there is if not in the National League but in baseball."

With considerable money invested in the bullpen, Towers said it's particularly important to have a strong group of relievers while Arizona's young starting rotation. He said Arizona still needs a late-inning left-handed reliever and perhaps a veteran starter.

This could be a sign Beane, the A's general manage, might try to move center fielder Coco Crisp, who signed a $14 million, two-year contract in January that includes a $7.5 million club option for 2014 with a $1 million buyout. Beane, however, said he plans to keep Crisp, though he realized there would be speculation otherwise.

" I really like our outfield," Beane said. "Everybody knows how important this guy is to this team and also has the benefit of being a personal favorite of mine."

Oakland already acquired shortstop Stephen Drew from the Diamondbacks this season and he helped them down the stretch. The A's overtook Texas on the final day of the regular season to win the AL West and returned to the playoffs for the first time since 2006. They lost in five games to the World Series-bound Detroit Tigers.

Beane said the day after the season ended he planned to keep his young team intact as much as possible. Last offseason, Oakland traded three top pitchers: Trevor Cahill to Arizona, Gio Gonzalez to Washington and closer Andrew Bailey to Boston.

The 29-year-old Young, a popular player in the Arizona clubhouse, has had three 20-homer, 20-steal seasons. He injured his right shoulder crashing into a wall while making a catch early this season and struggled at the plate after. A quadriceps injury in early September sent Young to the bench in favor of Eaton.

Canadian Space Agency Shows Off Prototype Rovers

An anonymous reader writes "At its headquarters in Longueuil, Que. Friday, the Canadian Space Agency rolled out a fleet of about a half-dozen prototype rovers that are the forerunners of vehicles that may one day explore the moon or Mars. The agency said the terrestrial rovers bring it one step closer to developing the next generation for space exploration."

remodeling a bathroom

NEW YORK ? According to the Remodeling magazine?s 2011-12 ?Cost vs. Value Report,? which compares the average cost for 35 popular remodeling projects with the value those projects retain at resale, homeowners can expect to spend upward of $52,000 on an upscale bathroom remodel.

That makes a bathroom remodel one of the more expensive home improvement projects a homeowner can undertake. For many homeowners, that costly price tag is simply too much money to commit, especially in an economy where money is still hard to come by.

Fortunately, there are several simple ways homeowners can give their bathrooms a new look and feel without breaking the bank.

Install a new shower

One of the best ways to give a bathroom a new look is to replace the traditional tub and showerhead with a bigger, more airy shower. Such showers are typically found in modern hotels that boast luxury amenities. Instead of the tub and slide glass, choose a hinged door with heavier glass, replacing the bathtub entirely.

Add windows and a skylight

Many bathrooms, particularly those in older homes, sorely lack adequate lighting. Adding some extra windows and a skylight can give a bathroom an entirely new look, even if you don?t replace any of the existing features or fixtures.

Sunlight can make a bathroom more inviting, giving the room the feeling of a sanctuary that many of today?s homeowners prefer.

Add some entertainment

Just like they offer larger showers with more room to breathe, many luxury hotels now ensure guests can be entertained even while they?re in the bathroom. Such hotels often feature small flatscreen televisions that sit behind the bathroom?s mirror. Guests don?t even see the television until it?s turned on.

Homeowners can bring this luxury into their own homes. This is especially valuable to homeowners whose bathrooms currently feature soaking tubs where they can escape the daily grind with a hot bath, and now watch a little television while they soak.

Replace old tiles

Many homeowners cite their bathroom?s tiles as the feature they would most like to change. Old linoleum tiles give many bathrooms a dated look that few of today?s homeowners find appealing.

Glass tiles are growing in popularity, but those old linoleum or glazed tiles can be swapped out with porcelain or stone tiles to give the room an entirely new look without spending excessively.

Replace the toilet

Another easy way to give a bathroom a new look is to replace the toilet. Older toilets may be eyesores and many are not very eco-friendly, either. A new toilet can give the bathroom a sleek, modern look, and since many of today?s luxury models are low-flow, you?ll also save money on your monthly water bill while doing something good for the environment.

Renovating a bathroom is a top priority for many homeowners. But if a full-scale remodel is not within your budget, there are still plenty of inexpensive ways to give your bathroom a new look and feel.
